New Towing Option Language, Additional Liability Protection Added
In May, Governor Abbott signed Senate Bill 1181, the "towing bill," into law. This law provides a self-storage facility the ability, in lieu of foreclosure, to tow certain vehicles away from the facility following a tenant’s abandonment of the property. The law is now in effect as of September 1, 2021. If you want to take advantage of the new towing option, your tenants will need to sign an updated rental agreement that includes the required towing language. If you do not offer vehicle or trailer parking at your facility, we still advise that you use the most recent version of the TSSA lease. As a result of a significant lawsuit against a large self-storage operator (recently settled), additional protection has also been added in the way of liability language addressing the removal of property as a result of a casualty or weather event.
These printed rental agreements are designed for the facility that prefers a paper form for the tenant to complete and sign onsite. Made with a carbon fabrication, both the tenant and facility retain a copy of the completed agreement. Printed TSSA rental agreements are sold in packages of 25, 50 and 100 and can be purchased online here. Members may also purchase the Spanish translation of the TSSA rental agreement in the TSSA shop.
TSSA offers the official rental agreement in an electronic format compatible with several self-storage management software programs. Installed directly into your software, this creates a seamless rental experience for both you and your tenants. The use of the electronic lease is billed annually with your membership dues. TSSA members have access to attorney-reviewed forms and addenda at no cost to supplement the terms in the lease and to support other circumstances that may arise including liens, eviction, business operations, employment and more. The TSSA Goldbook© provides guidance on the use of these forms. All additional forms and addenda are available in the Members Only section of the website.
